If you are planning building work that affects a shared wall, boundary, or excavation near a neighbouring property, the Party Wall etc. Act 1996 requires you to serve formal notice. This is not optional — failure to notify can result in injunctions, delays, and personal liability for damage.

The Act covers three distinct types of work, each with its own notice and its own notice period. A Section 3 party structure notice covers works directly to an existing party wall or structure, such as cutting in, raising, or underpinning, and must be served at least 2 months before work begins. A Section 1 line of junction notice covers the construction of a new wall on or at the boundary line, and requires at least 1 month. A Section 6 notice of adjacent excavation applies when you excavate within defined distances of an adjoining owner's foundations, and also requires at least 1 month.

Section 4 is often mistakenly described as a type of notice served by the person doing the work. It is not. Section 4 is the adjoining owner's counter-notice, which they may serve within one month of receiving a Section 3 party structure notice to require additional works for their own benefit. Work to an existing party wall is always notified under Section 3.

The Royal Institution of Chartered Surveyors (RICS) estimates that around 150,000 party wall notices are served each year in England and Wales (RICS Guidance). Instructing a surveyor typically costs between £1,000 and £2,000 per neighbour, making a correctly worded notice an essential first step.
